Article R3211-28 of the French Public Health Code

When it comes from the person who is the subject of psychiatric care, the application may be lodged with the secretariat of the host institution. The request for legal action may also be made by an oral statement taken by the director of the institution, who will draw up a report containing the information provided for in article R. 3211-10, dated and signed by himself and the person concerned. If the person concerned is unable to sign, this is noted.

The Director shall forward the application or the minutes to the court registry without delay, by any means that enables its receipt at the court registry to be dated, enclosing any supporting documents that the applicant intends to produce. The Director shall also send the court a file containing the documents referred to in article R. 3211-12 within five days of the application being filed.

Lorsqu’elle émane de la personne qui fait l’objet de soins psychiatriques, la requête peut être déposée au secrétariat de l’établissement d’accueil. La demande en justice peut également être formée par une déclaration verbale recueillie par le directeur de l’établissement qui établit un procès-verbal contenant les mentions prévues par l’article R. 3211-10, daté et revêtu de sa signature et de celle de l’intéressé. Si ce dernier ne peut signer, il en est fait mention.

Le directeur transmet sans délai la requête ou le procès-verbal au greffe du tribunal, par tout moyen permettant de dater sa réception au greffe du tribunal judiciaire, en y joignant les pièces justificatives que le requérant entend produire. Le directeur communique en outre au tribunal un dossier contenant les pièces mentionnées à l’article R. 3211-12 dans le délai de cinq jours suivant le dépôt de la requête.
