Article R3211-29 of the French Public Health Code

When the liberty and custody judge decides to refer the matter to himself pursuant to the last paragraph of I of article L. 3211-12, he shall give the person undergoing psychiatric care, his lawyer as soon as he has been appointed and, where applicable, the person in charge of the legal protection measure relating to the person or his legal representatives if he is a minor, the third party who requested the admission for psychiatric care, the prefect who ordered or maintained it, the director of the establishment who ordered the admission for psychiatric care in the event of imminent danger, as well as the public prosecutor, the opportunity to make observations. He notifies them of the date, time and place of the hearing. The notice of the hearing contains the information provided for in the last two paragraphs of article R. 3211-13. The director of the institution shall send the judge the documents mentioned in article R. 3211-12 within five days of the notice of referral.

Lorsque le juge des libertés et de la détention décide de se saisir d’office en application du dernier alinéa du I de l’article L. 3211-12, il met la personne qui fait l’objet de soins psychiatriques, son avocat dès sa désignation et, le cas échéant, la personne chargée de la mesure de protection juridique relative à la personne ou ses représentants légaux si elle est mineure, le tiers qui a demandé l’admission en soins psychiatriques, le préfet qui l’a ordonnée ou maintenue, le directeur d’établissement qui a prononcé l’admission en soins psychiatriques en cas de péril imminent, ainsi que le ministère public, en mesure de produire des observations. Il les fait aviser de la date, de l’heure et du lieu de l’audience. L’avis d’audience contient les informations prévues aux deux derniers alinéas de l’article R. 3211-13. Le directeur de l’établissement transmet au juge les pièces mentionnées à l’article R. 3211-12 dans le délai de cinq jours suivant l’avis de saisine.
