Article R3211-33-1 of the French Public Health Code

I.-When the director of the institution refers a case to the liberty and custody judge, in application of II of article L. 3222-5-1, the request is presented under the conditions set out in article R. 3211-10.

The application must be accompanied by the documents mentioned in article R. 3211-12 , as well as any previous seclusion or restraint decisions taken with regard to the patient and any other information likely to enlighten the judge.

II – The director will inform the patient that the matter has been referred to the liberty and custody judge. He will inform the patient that he may be assisted or represented by a chosen lawyer, appointed under the legal aid scheme or appointed by the court.

He will also inform the patient that he may ask to be heard by the liberty and custody judge and that he will be represented by a lawyer if the judge decides not to proceed with his hearing in the light of the medical opinion provided for in the second paragraph of III of Article L. 3211-12-2. Where appropriate, the Director shall obtain the patient’s acceptance or refusal of a hearing by telecommunication.

The Director shall inform the patient that he or she may have access to the documents attached to the request, in compliance with the provisions of Article L. 1111-7 in the case of documents forming part of the medical file. The cooling-off period provided for in the second paragraph of Article L. 1111-7 is not applicable.

III.The Director shall send the following information and documents to the court registry by any means capable of establishing a definite date of receipt, within ten hours of registering the request:

1° Where applicable, the name of the lawyer chosen by the patient or the indication that he/she is requesting that a lawyer be appointed to assist or represent him/her;

2° Where applicable, the patient’s wish to be heard by the liberty and custody judge and his/her acceptance or refusal of a hearing by means of telecommunication;

3° If the patient asks to be heard by the liberty and custody judge, a doctor’s opinion as to whether there are any medical grounds preventing him or her, in his or her interest, from being heard and whether the use of telecommunications is compatible with his or her mental state;

4° Any documents that the patient intends to produce.

I.-Lorsque le directeur de l’établissement saisit le juge des libertés et de la détention, en application du II de l’article L. 3222-5-1, la requête est présentée dans les conditions prévues à l’article R. 3211-10.

Sont jointes à la requête les pièces mentionnées à l’article R. 3211-12 ainsi que les précédentes décisions d’isolement ou de contention prises à l’égard du patient et tout autre élément de nature à éclairer le juge.

II.-Le directeur informe le patient de la saisine du juge des libertés et de la détention. Il lui indique qu’il peut, dans le cadre de cette instance, être assisté ou représenté par un avocat choisi, désigné au titre de l’aide juridictionnelle ou commis d’office.

Il lui indique également qu’il peut demander à être entendu par le juge des libertés et de la détention et qu’il sera représenté par un avocat si le juge décide de ne pas procéder à son audition au vu de l’avis médical prévu au deuxième alinéa du III de l’article L. 3211-12-2. Le directeur recueille le cas échéant son acceptation ou son refus d’une audition par des moyens de télécommunication.

Le directeur informe le patient qu’il peut avoir accès aux pièces jointes à la requête dans le respect, s’agissant des documents faisant partie du dossier médical, des prescriptions de l’article L. 1111-7. Le délai de réflexion prévu au deuxième alinéa de l’article L. 1111-7 n’est pas applicable.

III.-Le directeur communique au greffe par tout moyen permettant de donner date certaine à leur réception, dans un délai de dix heures à compter de l’enregistrement de sa requête, les informations et pièces suivantes :

1° Le cas échéant, le nom de l’avocat choisi par le patient ou l’indication selon laquelle il demande qu’un avocat soit commis d’office pour l’assister ou le représenter ;

2° Le cas échéant, le souhait du patient d’être entendu par le juge des libertés et de la détention ainsi que son acceptation ou son refus d’une audition par des moyens de télécommunication ;

3° Si le patient demande à être entendu par le juge des libertés et de la détention, un avis d’un médecin relatif à l’existence éventuelle de motifs médicaux faisant obstacle, dans son intérêt, à son audition et à la compatibilité de l’utilisation de moyens de télécommunication avec son état mental ;

4° Toute pièce que le patient entend produire.
