Article R3211-8 of the French Public Health Code

Before the liberty and custody judge and the first president of the court of appeal, the person undergoing psychiatric care is assisted or represented by a lawyer. He shall be represented by a lawyer if the judge decides, in the light of the medical opinion provided for in the second paragraph of article L. 3211-12-2, not to hear him. The other parties are not required to be represented by a lawyer.

Devant le juge des libertés et de la détention et le premier président de la cour d’appel, la personne faisant l’objet de soins psychiatriques est assistée ou représentée par un avocat. Elle est représentée par un avocat dans le cas où le magistrat décide, au vu de l’avis médical prévu au deuxième alinéa de l’article L. 3211-12-2, de ne pas l’entendre. Les autres parties ne sont pas tenues d’être représentées par un avocat.
