The specially-adapted unit within a healthcare establishment referred to in article L. 3214-1 deals with full hospitalisation, with or without their consent, of persons detained in prisons located in an area defined by joint order of the ministers responsible for justice, health and the interior.
In the case of hospitalisation with consent, admission is decided by the director of the health establishment of the specially adapted unit to which the detainee is attached, on the advice of the doctor in this unit.
In the case of hospitalisation without consent under the conditions defined by article L. 3214-3, the prefect of the département in which the prison to which the detainee is assigned is located decides on hospitalisation. If the specially adapted unit is located in a department other than that of the prison of origin, the prefect of this department will issue an order admitting the detainee to this unit.
