Article R322-10 of the French Code of civil enforcement procedures

At the latest on the fifth working day following the summons delivered to the distrainee debtor, the pursuing creditor deposits at the registry of the execution judge a schedule of conditions of sale containing a description of the property and the terms of the sale. A copy of the summons issued to the debtor and a certified mortgage statement as at the date of publication of the summons to pay serving as a seizure order are attached.
Under penalty of being declared null and void, the terms and conditions of sale contain :
1° A statement of the writ of execution by virtue of which the proceedings are being carried out;
2° A breakdown of the sums owed to the pursuing creditor in principal, costs and accrued interest, as well as an indication of the rate of default interest;
3° A statement of the summons to pay valid as a seizure, with a mention of its publication and other deeds and judgments issued subsequently;
4° A description of the property seized, the origin of ownership, any easements encumbering the property, any leases granted on the property and the description report;
5° The terms of the judicial sale and the upset price set by the pursuing creditor;
6° The appointment of a receiver of the funds from the sale or from the Caisse des dépôts et consignations.

Article R322-10

Au plus tard le cinquième jour ouvrable suivant l’assignation délivrée au débiteur saisi, le créancier poursuivant dépose au greffe du juge de l’exécution un cahier des conditions de vente comportant l’état descriptif de l’immeuble et les modalités de la vente. Il y est joint la copie de l’assignation délivrée au débiteur et un état hypothécaire certifié à la date de la publication du commandement de payer valant saisie.
Le cahier des conditions de vente contient à peine de nullité :
1° L’énonciation du titre exécutoire en vertu duquel les poursuites sont exercées ;
2° Le décompte des sommes dues au créancier poursuivant en principal, frais et intérêts échus ainsi que l’indication du taux des intérêts moratoires ;
3° L’énonciation du commandement de payer valant saisie avec la mention de sa publication et des autres actes et jugements intervenus postérieurement ;
4° La désignation de l’immeuble saisi, l’origine de propriété, les servitudes grevant l’immeuble, les baux consentis sur celui-ci et le procès-verbal de description ;
5° Les conditions de la vente judiciaire et la mise à prix fixée par le créancier poursuivant ;
6° La désignation d’un séquestre des fonds provenant de la vente ou de la Caisse des dépôts et consignations.
