Article R322-27 of the French Code of civil enforcement procedures

On the specified date, the pursuing creditor or, failing this, any registered creditor, who is then subrogated to the proceedings, requests the sale.
If no creditor requests the sale, the court declares that the summons to pay serving as a seizure has lapsed. In this case, the defaulting creditor retains all the costs of the seizure unless the court decides otherwise, giving its reasons.

Au jour indiqué, le créancier poursuivant ou, à défaut, tout créancier inscrit, alors subrogé dans les poursuites, sollicite la vente.
Si aucun créancier ne sollicite la vente, le juge constate la caducité du commandement de payer valant saisie. Dans ce cas, le créancier poursuivant défaillant conserve à sa charge l’ensemble des frais de saisie engagés sauf décision contraire du juge spécialement motivée.
