Article R3221-2 of the French Public procurement code

For the application of article L. 3214-1, the conceding authority publishes an award notice when the following cumulative conditions are met:
1° The estimated value of the concession contract is equal to or greater than the threshold mentioned in a notice annexed to this code;
2° The sectoral legislation of the European Union does not provide for transparency obligations for the award of this contract.

Article R3221-2

Pour l’application de l’article L. 3214-1, l’autorité concédante publie un avis d’attribution lorsque les conditions cumulatives suivantes sont remplies :
1° La valeur estimée du contrat de concession est égale ou supérieure au seuil mentionné dans un avis figurant en annexe du présent code ;
2° La législation sectorielle de l’Union européenne ne prévoit pas d’obligations de transparence pour l’attribution de ce contrat.
