Article R324-12 of the French Intellectual Property Code

If, at the end of the period provided for in Article R. 324-7, no agreement has been reached between the parties, the mediator may, by registered letter with acknowledgement of receipt, either make recommendations to the parties, or propose the solution that he or she deems appropriate for the settlement of all or part of the dispute.

Failing to express their opposition to the mediator in writing within three months of the date of receipt of his proposal, the parties shall be deemed to have accepted it.

Article R324-12

Si, à l’issue du délai prévu à l’article R. 324-7, aucun accord n’a pu être trouvé entre les parties, le médiateur peut, par lettre recommandée avec avis de réception, soit faire des recommandations aux parties, soit proposer la solution qu’il juge appropriée au règlement de tout ou partie du différend.

Faute d’avoir exprimé au médiateur leur opposition par écrit dans un délai de trois mois à compter de la date de réception de sa proposition, les parties sont réputées avoir accepté celle-ci.
