Article R324-2 of the French Intellectual Property Code

Mediators must meet the following conditions:

1. Enjoy their civil and political rights;

2. Not have been the perpetrator of acts contrary to honour, probity or good morals that have given rise to a disciplinary or administrative sanction;

3. Have the necessary qualifications to resolve the disputes referred to them;

4. Present the guarantees of independence necessary for the exercise of mediation and in particular not be a partner, manager, corporate officer or employee of a management body mentioned in article R. 324-1.

Article R324-2

Les médiateurs doivent remplir les conditions suivantes :

1. Jouir de leurs droits civils et politiques ;

2. Ne pas avoir été auteurs de faits contraires à l’honneur, à la probité et aux bonnes mœurs ayant donné lieu à une sanction disciplinaire ou administrative ;

3. Posséder la qualification nécessaire à la résolution des différends dont ils seront saisis ;

4. Présenter les garanties d’indépendance nécessaires à l’exercice de la médiation et notamment ne pas être associé, dirigeant, mandataire social ou salarié d’un organisme de gestion mentionné à l’article R. 324-1.
