Article R325-7 of the French Intellectual Property Code

If, on the date of publication of a work, the author and publisher have not designated a collective management organisation, the management of their right to remuneration for library lending is entrusted to the organisation with the largest number of works managed. This number is determined in accordance with the practices of the professions concerned.

The Minister responsible for culture designates each year the organisation that meets the condition defined in the previous paragraph.

Si, à la date de la publication d’une oeuvre, l’auteur et l’éditeur n’ont pas désigné un organisme de gestion collective, la gestion de leur droit à rémunération au titre du prêt en bibliothèque est confiée à l’organisme réunissant le plus grand nombre d’oeuvres gérées. Ce nombre est déterminé conformément aux usages des professions intéressées.

Le ministre chargé de la culture désigne chaque année l’organisme répondant à la condition définie à l’alinéa précédent.
