A collective management organisation governed by Title II of Book III may be approved under Article L. 134-3, if it:
1° Demonstrates, through the composition of its deliberative and management bodies, the diversity of its members on the basis of the categories and number of right holders, its economic importance expressed in terms of revenue or turnover and the diversity of editorial genres ;
1° bis Provides proof of its representativeness on the basis of the number of rights holders who have mandated it to manage their remuneration for the digital exploitation of unavailable books;
2° Provides proof of the equal representation of authors and publishers among its members and within its governing bodies;
3° Provides proof, by any means, of the professional qualifications of its managers and corporate officers on the basis of:
a) Their status as authors; or
b) The nature and level of their diplomas; or
c) Their experience in the publishing sector or in the management of professional bodies;
4° Gives the necessary information relating to:
a) The administrative organisation and conditions of installation and equipment;
b) The resources implemented to manage operations relating to unavailable books with regard to the provisions of Articles L. 134-1 et seq. and inform the Bibliothèque nationale de France for inclusion in the public database mentioned in Article L. 134-2;
c) The means used to collect remuneration and the processing of the data required to distribute this remuneration;
d) The financing plan and provisional budget for the three financial years following the application for authorisation;
5° Indicate the measures it has taken or intends to take to guarantee compliance with the rules for distributing remuneration between authors and publishers, the equitable nature of the rules for distributing the sums collected between right holders, whether or not they are parties to the publishing contract, and equal treatment between all right holders, whether or not they are members of the organisation, including with regard to the terms of the licence ;
6° Gives the necessary information relating to the means implemented in order to identify and trace the rightholders for the purpose of distributing the sums collected;
7° Gives the necessary information relating to the means implemented to develop contractual relationships that ensure the greatest possible availability of works;
8° Indicates the measures it has taken or intends to take to ensure the defence of the legitimate interests of rightholders not party to the publishing contract.
