Article R331-27 of the French Intellectual Property Code

I.-The Autorité de régulation de la communication audiovisuelle et numérique may reject as inadmissible an application referred to it where:

1° The subject of the application does not fall within its jurisdiction;

2° The application does not comply with the requirements of Article R. 331-24, after the expiry of the period of one month following the invitation to regularise which was sent to the applicant;

3° The author of the referral does not justify a standing or an interest to act.

II.-The authority may rule without investigation on referrals that are manifestly unfounded or manifestly inadmissible.

Article R331-27

I.-L’Autorité de régulation de la communication audiovisuelle et numérique peut rejeter pour irrecevabilité une demande dont elle a été saisie lorsque :

1° L’objet de la demande ne relève pas de sa compétence ;

2° La demande n’est pas conforme aux prescriptions de l’article R. 331-24, après l’expiration du délai d’un mois suivant l’invitation à régulariser qui a été adressée au demandeur ;

3° L’auteur de la saisine ne justifie pas d’une qualité ou d’un intérêt à agir.

II.-L’autorité peut statuer sans instruction sur les saisines manifestement infondées ou entachées d’une irrecevabilité manifeste.
