Article R332-10 of the French Code of civil enforcement procedures

The applications referred to in articles R. 332-6 and R. 332-8 must be accompanied by:

1° A mortgage statement dated after publication of the sale;

2° Proof of receipt of the proposed distribution;

3° The proposed distribution or the minutes of the agreement containing, where applicable, authorisation to release the registrations and to cancel the summons to pay in lieu of seizure;

4° The statements of registrations provided for in the first and second paragraphs of article R. 521-31 of the French Commercial Code.

Where the sale price comes from a property seizure, the following documents must also be attached:

1° The terms and conditions of sale;

2° The referral judgement;

3° Depending on the case, the judgement recording the sale, to which a copy of the out-of-court sale contract or the auction judgement is attached.

The order ruling on the request may not be appealed.

Aux requêtes mentionnées aux articles R. 332-6 et R. 332-8 sont joints :


1° Un état hypothécaire postérieur à la publication de la vente ;


2° Les justificatifs de réception du projet de distribution ;


3° Le projet de distribution ou le procès-verbal d’accord contenant, le cas échéant, autorisation de mainlevée des inscriptions et radiation du commandement de payer valant saisie ;

4° Des états des inscriptions prévus aux premier et deuxième alinéas de l’article R. 521-31 du code de commerce.


Lorsque le prix de vente provient d’une saisie immobilière, il est joint en outre :


1° Le cahier des conditions de vente ;


2° Le jugement d’orientation ;


3° Selon le cas, le jugement constatant la vente auquel est annexée la copie du contrat de vente amiable ou le jugement d’adjudication.


L’ordonnance statuant sur la requête n’est pas susceptible d’appel.
