Article R3332-9 of the French Public Health Code

In order to monitor the operation of the approved body, the Minister of the Interior and the Prefect of the département or, in Paris, the Prefect of the Police or, in the département of Bouches-du-Rhône, the Prefect of the Bouches-du-Rhône Police, shall have access to the premises used for training and to documents relating to such training.

If the conditions for issuing authorisation mentioned in article R. 3332-5, the criterion of economic independence mentioned in article R. 3332-6 or the obligations laid down in article R. 3332-7 or article R. 3332-8 are not met by the organisation, authorisation may be withdrawn by order of the authority mentioned in article R. 3332-4 after the latter has given the organisation the opportunity to present its observations.

Afin de permettre le contrôle du fonctionnement de l’organisme agréé, le ministre de l’intérieur et le préfet de département ou, à Paris, le préfet de police ou, dans le département des Bouches-du-Rhône, le préfet de police des Bouches-du-Rhône ont accès aux locaux affectés au déroulement des formations et aux documents afférents à ces formations.

Lorsque les conditions de délivrance de l’agrément mentionnées à l’article R. 3332-5, le critère d’indépendance économique mentionné à l’article R. 3332-6 ou les obligations fixées à l’article R. 3332-7 ou à l’article R. 3332-8 ne sont pas respectées par l’organisme, l’agrément peut lui être retiré par arrêté de l’autorité mentionnée à l’article R. 3332-4 après que celle-ci l’a mis en mesure de présenter ses observations.
