Article R335-8 of the French Intellectual Property Code

Where the written application is submitted after the applicant has been informed that the goods have been detained, the Minister responsible for customs shall accept or reject it within two working days of receipt.

If the application does not contain the specific and technical data on the genuine goods, the information necessary to enable the customs authorities to easily recognise the genuine goods and the information useful to the service in assessing the risk of infringement of the protected right(s), it shall be granted only in respect of the current detention of the goods, unless such information is provided within ten working days of notification of the detention.

Lorsque la demande écrite est présentée après que le demandeur a été informé du placement de la marchandise en retenue, le ministre chargé des douanes l’accepte ou la rejette dans un délai de deux jours ouvrables à compter de sa réception.

Si la demande ne contient pas les données spécifiques et techniques sur les marchandises authentiques, les informations nécessaires pour permettre aux autorités douanières de reconnaître facilement les marchandises authentiques et les informations utiles au service pour évaluer le risque de violation du ou des droits protégés, il n’y est fait droit que pour la retenue en cours des marchandises, sauf si ces informations sont communiquées dans un délai de dix jours ouvrables à compter de la notification de la retenue.
