Article R3354-12 of the French Public Health Code

If the checks are carried out following a traffic accident that occurred under the conditions set out in Article L. 3354-1, the officer or agent of the judicial police shall send :

1° The first blood sample taken, together with four copies of forms A and B, to the laboratory of a health establishment or to an expert biologist on the list provided for in Article R. 3354-20;

2° The second sample, together with one copy of sheets A and B, to another expert biologist on the same list who may be responsible for carrying out the control analysis.

The laboratory or expert biologist who carried out the analysis records the results on form C and sends a copy of forms A, B and C directly, in a sealed envelope and with a confidential stamp, to the person concerned, the Prefect and the Public Prosecutor at the scene of the accident. Form C is given to the criminal investigation officer.

Si les vérifications sont faites à la suite d’un accident de la circulation survenu dans les conditions prévues à l’article L. 3354-1, l’officier ou l’agent de police judiciaire adresse :

1° Le premier échantillon de sang prélevé accompagné de quatre exemplaires des fiches A et B au laboratoire d’un établissement de santé ou à un biologiste expert inscrit sur la liste prévue à l’article R. 3354-20 ;

2° Le deuxième échantillon accompagné d’un exemplaire des fiches A et B à un autre biologiste expert inscrit sur la même liste et chargé de procéder éventuellement à l’analyse de contrôle.

Le laboratoire ou le biologiste expert qui a procédé à l’analyse en consigne les résultats sur la fiche C et adresse un exemplaire des fiches A, B et C directement sous pli fermé et timbre confidentiel à l’intéressé, au préfet et au procureur de la République du lieu de l’accident. La fiche C est communiquée à l’officier ou agent de police judiciaire.
