Article R3354-16 of the French Public Health Code

The medical expert sends the report, together with the three forms A, B and C, to the competent public prosecutor, in a sealed envelope and under a confidential stamp.

He will also send a copy of the expert report, under the same conditions, to the medical inspector for public health in the department where the offence or accident occurred.

The person concerned may, on request to the Public Prosecutor, obtain a copy of the expert report. The costs incurred by this communication are to be borne by the person concerned.

Le médecin expert adresse le rapport, ainsi que les trois fiches A, B et C, au procureur de la République compétent, sous pli fermé et sous timbre confidentiel.

Il adresse également copie dans les mêmes conditions du rapport d’expertise au médecin inspecteur de santé publique du département du lieu de l’infraction ou de l’accident.

L’intéressé peut, sur demande adressée au procureur de la République, obtenir communication du rapport d’expertise. Les frais exigés par cette communication sont à la charge de l’intéressé.
