At least two expert biologists responsible for carrying out the analyses provided for in articles R. 3354-13 and R. 3354-14 and one or more expert doctors whose duties are provided for in article R. 3354-15 are entered under a special heading on the list of experts drawn up by each court of appeal in application of the provisions of article 157 of the Code of Criminal Procedure.
The inclusion of biologists and medical experts on this list, as well as, where applicable, their non-inclusion or removal during the course of the year, is carried out in accordance with the terms and conditions set out in Decree no. 2004-1463 of 23 December 2004 relating to legal experts.
When a member of the military has committed an offence mentioned in article L. 3354-1 in the service or on military premises, without a civilian being implicated, the operations defined in articles R. 3354-11 to R. 3354-16 may be carried out by military biologists and medical experts, appointed by order of the Minister of Defence. One biologist and one medical expert, as well as a deputy for each of them, are appointed within the jurisdiction of each land area or maritime district.
The provisions of article R. 3354-17 do not apply in this case.
