Article R351-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When, following the personal interview with the applicant, the French Office for the Protection of Refugees and Stateless Persons considers, pursuant to article L. 351-3, that the foreign national requires special procedural guarantees that are not compatible with his or her presence in the waiting area, it shall immediately forward its decision to the authority that placed the foreign national in the waiting area and to the Minister responsible for immigration. The foreign national’s presence in the waiting area is then terminated. The regularisation visa provided for in article L. 342-19 is given to the foreign national by the person in charge of the waiting area or his/her representative.

Lorsque, à la suite de l’entretien personnel avec le demandeur, l’Office français de protection des réfugiés et apatrides considère, en application de l’article L. 351-3, que l’étranger nécessite des garanties procédurales particulières qui ne sont pas compatibles avec sa présence en zone d’attente, il transmet sans délai sa décision à l’autorité qui a procédé au placement en zone d’attente ainsi qu’au ministre chargé de l’immigration. Il est alors mis fin à la présence de l’étranger en zone d’attente. Le visa de régularisation prévu à l’article L. 342-19 est remis à l’étranger par le responsable de la zone d’attente ou son représentant.
