Article R362-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book to Saint-Barthélemy:

1° References to the departmental council are replaced by references to the territorial council of Saint-Barthélemy;

2° References to the prefect are replaced by references to the representative of the State in the collectivity;

3° In article R. 311-1, after the words: “the Minister responsible for Immigration”, the words: “the Minister of Foreign Affairs and the Minister responsible for Overseas Territories” are inserted and the words: “in France” are replaced by the words: “in Saint-Barthélemy”;

3° bis In Article R. 312-8, the reference to Articles D. 312-5-1, D. 312-5-2 and D. 312-7-2 is replaced by the reference to articles D. 312-5-1 and D. 312-5-2;

4° In articles R. 332-1 and R. 341-1, after the words: “a civil servant designated by him, holding at least the rank of brigadier” and the words: “a civil servant designated by him, holding at least the rank of second-class senior recording officer”, the following words are added: “or by the national gendarmerie unit commander or a military officer, holding at least the rank of gendarme”;

5° The second paragraph of Article R. 351-1 does not apply;

6° In Article R. 351-3, the words: “Except in cases where the examination of the asylum application falls within the jurisdiction of another State,” are deleted.

Article R362-3

Pour l’application du présent livre à Saint-Barthélemy :

1° Les références au conseil départemental sont remplacées par la référence au conseil territorial de Saint-Barthélemy ;

2° Les références au préfet sont remplacées par la référence au représentant de l’Etat dans la collectivité ;

3° A l’article R. 311-1, après les mots : ” du ministre chargé de l’immigration “, sont insérés les mots : ” du ministre des affaires étrangères et du ministre chargé de l’outre-mer ” et les mots : ” en France ” sont remplacés par les mots : ” à Saint-Barthélemy ” ;

3° bis A l’article R. 312-8, la référence aux articles D. 312-5-1, D. 312-5-2 et D. 312-7-2 est remplacée par la référence aux articles D. 312-5-1 et D. 312-5-2 ;

4° Aux articles R. 332-1 et R. 341-1, après les mots : ” un fonctionnaire désigné par lui, titulaire au moins du grade de brigadier ” et les mots : ” un fonctionnaire désigné par lui, titulaire au moins du grade d’agent de constatation principal de deuxième classe “, sont ajoutés les mots : ” ou par le commandant d’unité de la gendarmerie nationale ou un militaire, titulaire au moins du grade de gendarme ” ;

5° Le deuxième alinéa de l’article R. 351-1 n’est pas applicable ;

6° A l’article R. 351-3, les mots : ” Sauf dans le cas où l’examen de la demande d’asile relève de la compétence d’un autre Etat, ” sont supprimés.
