Article R38 of the French Code of Criminal Procedure

The decision of the first president of the court of appeal is given in open court.

This decision is notified to the applicant and the judicial agent of the State either by delivery of a copy against receipt, or by registered letter with acknowledgement of receipt. The notification states that the decision may be appealed to the National Commission for Compensation for Detentions within ten days.

A copy of the decision is given to the public prosecutor.

A copy of the decision is also sent, at the Ministry of Justice, to the commission for monitoring pre-trial detention.

La décision du premier président de la cour d’appel est rendue en audience publique.

Cette décision est notifiée au demandeur et à l’agent judiciaire de l’Etat soit par remise d’une copie contre récépissé, soit par lettre recommandée avec demande d’avis de réception. La notification indique que la décision peut faire l’objet d’un recours devant la Commission nationale de réparation des détentions dans un délai de dix jours.

Une copie de la décision est remise au procureur général.

Une copie de la décision est en outre adressée, au ministère de la justice, à la commission de suivi de la détention provisoire.
