Article R40-39 of the French Code of Criminal Procedure

The authorisations provided for in Article 230-25 are issued under the following conditions:

1° For officers of the national police services carrying out judicial police duties, either by the heads of the territorial services of the national police, or by the heads of the active services at the police prefecture or, where applicable, the police prefect, or by the heads of the central services of the national police or, where applicable, the director general to whom they report ;

2° For members of the national gendarmerie units carrying out judicial police missions, either by the group commanders, or by the gendarmerie commanders in the overseas departments and collectivities and in New Caledonia, or by the regional commanders, or by the specialised gendarmerie commanders, or by the deputy director of the judicial police or, where applicable, by the director general of the national gendarmerie.

Article R40-39

Les habilitations prévues à l’article 230-25 sont délivrées dans les conditions suivantes :

1° Pour les agents des services de la police nationale exerçant des missions de police judiciaire, soit par les chefs des services territoriaux de la police nationale, soit par les chefs des services actifs à la préfecture de police ou, le cas échéant, le préfet de police, soit par les chefs des services centraux de la police nationale ou, le cas échéant, le directeur général dont ils relèvent ;

2° Pour les militaires des unités de la gendarmerie nationale exerçant des missions de police judiciaire, soit par les commandants de groupement, soit par les commandants de la gendarmerie dans les départements et les collectivités d’outre-mer et en Nouvelle-Calédonie, soit par les commandants de région, soit par les commandants des gendarmeries spécialisées, soit par le sous-directeur de la police judiciaire ou, le cas échéant, par le directeur général de la gendarmerie nationale.
