Article R411-23 of the French Intellectual Property Code

The National Institute of Industrial Property is not a party to the proceedings.

The Court of Appeal shall rule after hearing the Director General of the National Institute of Industrial Property or the Director General of the National Institute of Industrial Property who has been summoned and after giving him an opportunity to present written or oral observations.

The Public Prosecutor may take notice of cases in which he considers that he should intervene.

La cour d’appel statue après avoir entendu le directeur général de l’Institut national de la propriété industrielle ou celui-ci appelé et l’avoir mis en mesure de présenter des observations écrites ou orales.

Le ministère public peut prendre communication des affaires dans lesquelles il estime devoir intervenir.
