Article R411-25 of the French Intellectual Property Code

Appeals shall be brought before the Court of Appeal by deed containing, in addition to the particulars prescribed by 3° of Article 54 of the Code of Civil Procedure, and on pain of nullity:

1° The unique identification number of the applicant company or any document equivalent to the extract of registration in the trade and companies register for operators located outside France;

2° The subject of the appeal;

3° The name and address of the title holder if the applicant does not have this capacity;

4° The constitution of the applicant’s lawyer.

Except in the case of an implied decision to reject, a copy of the contested decision is attached to this act on pain of nullity.

The act is dated and signed by the lawyer constituted. It shall be delivered to the court registry and shall constitute an application for entry on the roll.

Les recours sont portés devant la cour d’appel par acte contenant, outre les mentions prescrites par le 3° de l’article 54 du code de procédure civile, et à peine de nullité :

1° Le numéro unique d’identification de l’entreprise requérante ou tout document équivalent à l’extrait d’immatriculation au registre du commerce et des sociétés pour les opérateurs situés hors de France ;

2° L’objet du recours ;

3° Le nom et l’adresse du titulaire du titre si le requérant n’a pas cette qualité ;

4° La constitution de l’avocat du requérant.

Sauf en cas de décision implicite de rejet, une copie de la décision attaquée est jointe à cet acte à peine de nullité.

L’acte est daté et signé par l’avocat constitué. Il est remis au greffe et vaut demande d’inscription au rôle.
