The following principles, which are traditional in the practice of dentistry, are binding on all dentists, except in cases where their observance would be incompatible with a legislative or regulatory requirement, or would be likely to compromise the rational operation and normal development of social medical services or institutions.
These principles are
Free choice of the dental surgeon by the patient;
Freedom of prescription by the dental surgeon;
Direct agreement between patient and dental surgeon on fees;
Direct payment of fees by the patient to the dental surgeon.
When a derogation is made from one of these principles for one of the reasons mentioned in the first paragraph of this article, the practitioner concerned must make available to the departmental council and, where applicable, to the National Council of the Association, any documents that are likely to establish that the service or institution with which the practitioner practises falls into one of the categories defined in the said first paragraph and that the provisions of article L. 4113-5 have not been disregarded.
