Article R4127-236 of the French Public Health Code

The consent of the person being examined or treated is sought in all cases, under the conditions defined in Article L. 1111-4.

When the patient, capable of expressing his or her wishes, refuses the proposed investigations or treatment, the dental surgeon must respect this refusal after informing the patient of the consequences.

When it is impossible to obtain in good time the consent of the legal representative of a minor or, in the case of an adult subject to a legal protection measure with representation relating to the person who is not capable of expressing his or her wishes, the authorisation of the person responsible for his or her protection, the dental surgeon must nevertheless, in an emergency, provide the care he or she considers necessary.

Le consentement de la personne examinée ou soignée est recherché dans tous les cas, dans les conditions définies à l’article L. 1111-4.

Lorsque le patient, en état d’exprimer sa volonté, refuse les investigations ou le traitement proposés, le chirurgien-dentiste doit respecter ce refus après l’avoir informé de ses conséquences.

Lorsqu’il est impossible de recueillir en temps utile le consentement du représentant légal d’un mineur ou, dans le cas d’un majeur faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne qui n’est pas apte à exprimer sa volonté, l’autorisation de la personne chargée de sa protection, le chirurgien-dentiste doit néanmoins, en cas d’urgence, donner les soins qu’il estime nécessaires.
