I. – The dental surgeon must always determine the amount of his fees with tact and moderation.
The factors to be taken into account are, independently of the importance and difficulty of the treatment, the material situation of the patient, the reputation of the practitioner and the particular circumstances.
Dental surgeons are free to provide treatment free of charge. However, he is prohibited from lowering his fees in order to attract clients.
II. – The dental surgeon complies with the provisions of articles L. 1111-3-2 and L. 1111-3-3 with regard to informing the patient of the costs relating to his services and the conditions under which these costs are covered and waived in advance. He shall ensure that the patient is informed in advance of the amount of the fees.
Any dental surgeon who presents his practice to the public, in particular on a website, must include information on the fees charged, the methods of payment accepted and the obligations imposed by law to allow all persons access to prevention or care without discrimination. The information must be clear, honest, accurate and non-comparative.
For the application of the first two paragraphs, the dental surgeon shall take account of the recommendations of the Conseil National de l’Ordre.
Dental surgeons must respond to any request for information or explanations about their fees or the cost of treatment.
III. – The dental surgeon may only request an advance payment when the importance of the treatment justifies it and in accordance with the practices of the profession. He may not refuse to issue a receipt for any payment on account.
No particular method of payment may be imposed on the patient.
