Article R4127-250 of the French Public Health Code

Except in emergencies, and subject to the legislative or regulatory provisions relating to occupational medical and social services, any dental surgeon who carries out a preventive dental service on behalf of a community is not entitled to provide curative care. He must refer the person he has recognised as ill to the attending dental surgeon or, if the patient does not have one, leave him free to choose one. This prescription also applies to a dental surgeon who provides a public screening consultation. However, he may provide treatment for :

1° Patients subject to the internship regime in an establishment with which he may be accredited as a dental surgeon;

2° Patients under the care of works, establishments and institutions authorised for this purpose, in the public interest, by the Minister for Health after obtaining the opinion of the Conseil national de l’ordre des chirurgiens-dentistes.

Sauf cas d’urgence, et sous réserve des dispositions législatives ou réglementaires relatives aux services médicaux et sociaux du travail, tout chirurgien-dentiste qui pratique un service dentaire préventif pour le compte d’une collectivité n’a pas le droit d’y donner des soins curatifs. Il doit renvoyer la personne qu’il a reconnue malade au chirurgien-dentiste traitant ou, si le malade n’en a pas, lui laisser toute latitude d’en choisir un. Cette prescription s’applique également au chirurgien-dentiste qui assure une consultation publique de dépistage. Toutefois, il peut donner ses soins lorsqu’il s’agit :

1° De patients astreints au régime de l’internat dans un établissement auprès duquel il peut être accrédité comme chirurgien-dentiste ;

2° De patients dépendant d’oeuvres, d’établissements et d’institutions autorisés à cet effet, dans un intérêt public, par le ministre chargé de la santé après avis du Conseil national de l’ordre des chirurgiens-dentistes.
