The usual place of practice of a dental surgeon is that of the professional residence in respect of which he is registered on the roll of the departmental council, in accordance with article L. 4112-1.
A dental surgeon practising on a self-employed basis may carry out his professional activity on one or more sites distinct from his usual professional residence:
-where, in the geographical sector in question, there is a shortage or insufficiency of care that is prejudicial to the needs of patients or to the continuity of care ;
-or when the investigations and care he undertakes require a suitable environment, the use of special equipment, the application of specific techniques or the coordination of different professionals.
The dental surgeon will take all necessary steps to ensure that emergency response, quality, safety and continuity of care are guaranteed at all these practice sites.
The request to open a separate place of practice is sent to the departmental council in whose area of jurisdiction the planned activity is located by registered letter with acknowledgement of receipt. It must be accompanied by all relevant information on the conditions of practice. If this information is insufficient, the departmental council will request further details.
The departmental council on whose roll the dental surgeon is registered is informed of the application if it concerns a site located in another department.
The authorisation is issued by the departmental council within three months of the date of receipt of the complete application for authorisation or, on appeal, by the national council, which gives its decision under the same conditions.
The authorisation is personal and non-transferable. It may be terminated if the condition set out in the third paragraph is no longer met.
Appeals against decisions to refuse or revoke authorisation are only admissible if they have been preceded by an administrative appeal to the Conseil national de l’ordre.
