Article R4127-276-1 of the French Public Health Code

The dental surgeon or the practice partnership may, with authorisation, enlist the help of other employees, self-employed persons or student assistants.

This authorisation is given by the departmental council on whose roll the holder of the practice or the company is registered:

1° When the needs of public health so require, for a period of three years ;

2° In the event of an exceptional influx of people, for a period of three months;

3° When the state of health of the practice owner or a practising partner so warrants, for a period of three months.

If the proprietor of the practice or the company wishes to enlist the help of more than two practitioners or student assistants, authorisation is given by the Conseil national de l’ordre, after obtaining the opinion of the Conseil départemental, under the conditions and for the periods set out above.

For any other reason, authorisation is also given by the Conseil national de l’ordre, after consultation with the departmental council on whose roll the practice holder or the company is registered, for a period that it determines in the light of specific situations.

The authorisation is given on a personal basis to the holder of the practice or to the company. It is renewable.

If no response is received from the departmental council or the national council within two months of the date of receipt of the application for authorisation or renewal, the authorisation is deemed to have been implicitly granted.

Le chirurgien-dentiste ou la société d’exercice peut, sur autorisation, s’attacher le concours d’autres collaborateurs, salariés ou libéraux, ou étudiants adjoints.

Cette autorisation est donnée par le conseil départemental au tableau duquel le titulaire du cabinet ou la société est inscrit :

1° Lorsque les besoins de la santé publique l’exigent, pour une durée de trois ans ;

2° En cas d’afflux exceptionnel de population, pour une durée de trois mois ;

3° Lorsque l’état de santé du titulaire ou d’un associé exerçant le justifie, pour une durée de trois mois.

Si le titulaire du cabinet ou la société souhaite s’attacher le concours de plus de deux praticiens ou étudiants adjoints, l’autorisation est donnée par le Conseil national de l’ordre, après avis du conseil départemental, dans les conditions et pour les durées prévues précédemment.

Pour tout autre motif, l’autorisation est également donnée par le Conseil national de l’ordre, après avis du conseil départemental au tableau duquel le titulaire du cabinet ou la société est inscrit, pour une durée qu’il détermine compte tenu des situations particulières.

L’autorisation est donnée à titre personnel au titulaire du cabinet ou à la société. Elle est renouvelable.

Le silence gardé par le conseil départemental ou par le conseil national à l’expiration d’un délai de deux mois à compter de la date de réception de la demande d’autorisation ou de renouvellement vaut autorisation implicite.
