Article R4127-277 of the French Public Health Code

A dental surgeon or dental surgery student who has been a replacement or assistant to a dental surgeon for a period of more than three consecutive months must not practise before the expiry of a period of two years in a position where he or she may enter into competition with that dental surgeon, subject to agreement between the contracting parties or, failing that, authorisation from the Conseil Départemental de l’Ordre given on the basis of public health needs.

Any clause intended to impose such a prohibition when the replacement or assistantship is for less than three months would be contrary to professional ethics.

Le chirurgien-dentiste ou l’étudiant en chirurgie dentaire qui a été remplaçant ou adjoint d’un chirurgien-dentiste pour une durée supérieure à trois mois consécutifs ne doit pas exercer avant l’expiration d’un délai de deux ans dans un poste où il puisse entrer en concurrence avec ce chirurgien-dentiste, sous réserve d’accord entre les parties contractantes ou, à défaut, d’autorisation du conseil départemental de l’ordre donnée en fonction des besoins de la santé publique.

Toute clause qui aurait pour objet d’imposer une telle interdiction lorsque le remplacement ou l’assistanat est inférieur à trois mois serait contraire à la déontologie.
