The dental surgeon or any joint practice company, whatever its form, must not set up in the building where a colleague is practising without the agreement of the latter or, failing this, without the authorisation of the departmental council of the order.
It is forbidden to set up in a professional capacity in premises or a building vacated by a colleague for a period of two years following his departure, unless an agreement has been reached between the two practitioners concerned or, failing this, authorisation has been obtained from the Association’s Departmental Council.
The decisions of the departmental council may only be based on public health needs. Silence on the part of the departmental council will be deemed to constitute tacit authorisation on expiry of a period of two months from the date of receipt of the request.
