Article R4127-278 of the French Public Health Code

The dental surgeon or any joint practice company, whatever its form, must not set up in the building where a colleague is practising without the agreement of the latter or, failing this, without the authorisation of the departmental council of the order.

It is forbidden to set up in a professional capacity in premises or a building vacated by a colleague for a period of two years following his departure, unless an agreement has been reached between the two practitioners concerned or, failing this, authorisation has been obtained from the Association’s Departmental Council.

The decisions of the departmental council may only be based on public health needs. Silence on the part of the departmental council will be deemed to constitute tacit authorisation on expiry of a period of two months from the date of receipt of the request.

Le chirurgien-dentiste ou toute société d’exercice en commun, quelle que soit sa forme, ne doit pas s’installer dans l’immeuble où exerce un confrère sans l’agrément de celui-ci ou, à défaut, sans l’autorisation du conseil départemental de l’ordre.

Il est interdit de s’installer à titre professionnel dans un local ou immeuble quitté par un confrère pendant les deux ans qui suivent son départ, sauf accord intervenu entre les deux praticiens intéressés ou, à défaut, autorisation du conseil départemental de l’ordre.

Les décisions du conseil départemental de l’ordre ne peuvent être motivées que par les besoins de la santé publique. Le silence gardé par le conseil départemental vaut autorisation tacite à l’expiration d’un délai de deux mois à compter de la date de réception de la demande.
