Article R4127-316 of the French Public Health Code

When a midwife discerns that a woman to whom she is called, or her child, is being abused, she must use the most appropriate means to protect them, exercising caution and circumspection.

In the case of a minor child or a woman who is unable to protect herself because of her age or her physical or mental state, she must, except in special circumstances which she assesses according to her conscience, alert the judicial, medical or administrative authorities.

Lorsqu’une sage-femme discerne qu’une femme auprès de laquelle elle est appelée ou son enfant est victime de sévices, elle doit mettre en oeuvre les moyens les plus adéquats pour les protéger en faisant preuve de prudence et de circonspection.

S’il s’agit d’un enfant mineur ou d’une femme qui n’est pas en mesure de se protéger en raison de son âge ou de son état physique ou psychique, elle doit, sauf circonstances particulières qu’elle apprécie en conscience, alerter les autorités judiciaires, médicales ou administratives.
