Article R4127-321 of the French Public Health Code

Any competition between midwives and doctors, pharmacists, medical auxiliaries or any other persons, even those not involved in medicine, is prohibited.

Competition is understood to mean intelligence between two or more persons with a view to obtaining advantages to the detriment of the patient or third parties.

It is forbidden for a midwife to give consultations in commercial premises, unless an exemption has been granted by the Conseil Départemental de l’Ordre, as well as in any premises where medicines, products or appliances that the midwife prescribes or uses are offered for sale, and in the outbuildings of such premises.

Tout compérage entre sages-femmes et médecins, pharmaciens, auxiliaires médicaux ou toutes autres personnes, même étrangères à la médecine, est interdit.

On entend par compérage l’intelligence entre deux ou plusieurs personnes en vue d’avantages obtenus au détriment de la patiente ou de tiers.

Il est interdit à une sage-femme de donner des consultations dans des locaux commerciaux, sauf dérogation accordée par le conseil départemental de l’ordre, ainsi que dans tout local où sont mis en vente des médicaments, des produits ou des appareils que cette sage-femme prescrit ou utilise et dans les dépendances desdits locaux.
