Article R4127-343 of the French Public Health Code

A midwife may not employ another midwife or a student midwife on her behalf in the practice of her profession. However, the midwife may be assisted by another midwife in exceptional circumstances, in particular in the event of a considerable influx of people; in this case, authorisation is subject to an individual decision by the departmental council of the Association. If the departmental council remains silent, tacit authorisation is granted two months after receipt of the application.

Il est interdit à une sage-femme d’employer pour son compte dans l’exercice de sa profession une autre sage-femme ou une étudiante sage-femme. Toutefois, la sage-femme peut être assistée par une autre sage-femme dans des circonstances exceptionnelles, notamment en cas d’afflux considérable de population ; dans cette éventualité, l’autorisation fait l’objet d’une décision individuelle du conseil départemental de l’ordre. Le silence gardé par le conseil départemental vaut autorisation tacite à l’expiration d’un délai de deux mois à compter de la date de réception de la demande.
