Contracts and agreements relating to the practice of the profession of midwife must be in writing.
Any association or partnership between midwives with a view to practising the profession must be the subject of a written contract which respects the independence of each of them.
In accordance with the provisions of article L. 4113-9, contracts and amendments thereto must be communicated to the Conseil départemental de l’ordre to which they belong, which will check that they comply with the principles of this Code of Ethics and, where they exist, with the essential clauses of the standard contracts drawn up by the Conseil national.
The Conseil départemental de l’ordre may, if it considers it useful, forward contracts or amendments to the Conseil national for its opinion.
The midwife must sign and submit to the Departmental Council a declaration stating on her honour that she has not entered into any counter-letter relating to the contract or amendment submitted to the Council for examination.
