The usual place of practice for a midwife is that of the professional residence in respect of which she is registered on the roll of the Conseil Départemental de l’Ordre, in accordance with article L. 4112-1.
However, in the interests of patients and new-born babies, a midwife may carry out her professional activity on one or more sites other than her usual professional residence:
-where, in the geographical area in question, there is a shortage or insufficiency of care provision prejudicial to the needs of patients and new-born babies ;
-or when the investigations and care she undertakes require a suitable environment, the use of special equipment, the application of specific techniques or the coordination of different professionals.
The midwife must take all steps, and justify these steps, to ensure the quality, safety and continuity of care at all these practice sites.
The application to open a separate place of practice must be sent to the departmental council in whose area the planned activity is located. It must be accompanied by all relevant information on the conditions of practice. If this information is insufficient, the departmental council must request further details.
The Departmental Council on whose roll the midwife is registered is informed of the application to open a site located in another department.
Silence on the part of the departmental council requested implies authorisation on expiry of a period of three months from the date of receipt of the application or the response to the request for further information.
The authorisation is personal and non-transferable. It may be terminated if the conditions set out in the previous paragraphs are no longer met.
