Subject to the provisions of article L. 1111-5, a doctor called upon to provide care to a minor must endeavour to inform his parents or legal representative and obtain their consent. If the minor is capable of expressing his wishes and participating in the decision, his consent must also be sought.
A doctor called upon to provide care to an adult who is the subject of a legal protection measure with representation relating to the person must obtain the adult’s consent, where appropriate with the assistance of the person in charge of the protection measure. If the person of full age is subject to a legal protection measure with personal representation and is not capable of expressing his wishes, the doctor must obtain the authorisation of the person in charge of the protection measure, who will take into account the opinion expressed by the person concerned. Except in emergencies, in the event of disagreement between the protected adult and the person responsible for his or her protection, the judge will authorise one or other of them to make the decision.
In an emergency, the doctor must provide the necessary care.
