Article R4127-65 of the French Public Health Code

A doctor may only be replaced in his practice on a temporary basis by a colleague registered on the roll of the ordre or by a student meeting the conditions laid down in article L. 4131-2.

A doctor who is to be replaced must, except in emergencies, inform his local Association Council in advance, stating the name and position of the replacement as well as the dates and duration of the replacement.

The replacement is personal.

The doctor being replaced must cease all independent medical practice for the duration of the replacement. However, exceptions to this rule may be granted by the departmental council, in the interests of the population, when it finds that there is a shortage or inadequacy in the supply of care.

Un médecin ne peut se faire remplacer dans son exercice que temporairement et par un confrère inscrit au tableau de l’ordre ou par un étudiant remplissant les conditions prévues par l’article L. 4131-2.

Le médecin qui se fait remplacer doit en informer préalablement, sauf urgence, le conseil de l’ordre dont il relève en indiquant les nom et qualité du remplaçant ainsi que les dates et la durée du remplacement.

Le remplacement est personnel.

Le médecin remplacé doit cesser toute activité médicale libérale pendant la durée du remplacement. Toutefois, des dérogations à cette règle peuvent être accordées par le conseil départemental, dans l’intérêt de la population lorsqu’il constate une carence ou une insuffisance de l’offre de soins.
