Article R4127-84 of the French Public Health Code

The regular practice of medicine, in any form whatsoever, within a State administration, a local authority or a public establishment must be the subject of a written contract, except in cases where the doctor is a permanent employee of the State, a local authority or a public establishment, as well as cases where he is governed by legislative or regulatory provisions which do not provide for the conclusion of a contract.

The doctor is obliged to communicate this contract to the competent body of the Ordre des Médecins. Any observations that this body may have to make are sent by it to the administrative authority concerned and to the doctor concerned.

L’exercice habituel de la médecine, sous quelque forme que ce soit, au sein d’une administration de l’Etat, d’une collectivité territoriale ou d’un établissement public doit faire l’objet d’un contrat écrit, hormis les cas où le médecin a la qualité d’agent titulaire de l’Etat, d’une collectivité territoriale ou d’un établissement public ainsi que les cas où il est régi par des dispositions législatives ou réglementaires qui ne prévoient pas la conclusion d’un contrat.

Le médecin est tenu de communiquer ce contrat à l’instance compétente de l’ordre des médecins. Les observations que cette instance aurait à formuler sont adressées par elle à l’autorité administrative intéressée et au médecin concerné.
