Article R4127-86 of the French Public Health Code

A doctor or a student who has replaced one of his colleagues for three months, whether consecutive or not, must not, for a period of two years, set up in a practice where he may enter into direct competition with the doctor replaced and with the doctors who, where applicable, practice in association with the latter, unless there is an agreement between the parties concerned which must be notified to the departmental council.

In the absence of an agreement between all the parties concerned, the installation is subject to authorisation by the Departmental Council.

Un médecin ou un étudiant qui a remplacé un de ses confrères pendant trois mois, consécutifs ou non, ne doit pas, pendant une période de deux ans, s’installer dans un cabinet où il puisse entrer en concurrence directe avec le médecin remplacé et avec les médecins, qui, le cas échéant, exercent en association avec ce dernier, à moins qu’il n’y ait entre les intéressés un accord qui doit être notifié au conseil départemental.

A défaut d’accord entre tous les intéressés, l’installation est soumise à l’autorisation du conseil départemental de l’ordre.
