After receiving the reasoned opinion of the committee referred to in Article R. 4163-37, the director of the local managing body notifies the employee and the employer of his decision, indicating the appeal procedures and deadlines, by any means that can be used to certify the date of receipt. It may impose the penalty referred to in article R. 4163-33 as part of its decision.

If necessary, the management body will open the professional prevention account or modify it accordingly.

Le directeur de l’organisme gestionnaire au niveau local notifie, après l’avis motivé de la commission mentionnée à l’article R. 4163-37, sa décision avec mention des voies et délais de recours par tout moyen permettant d’en attester la date de réception au salarié et à l’employeur. Il peut assortir sa décision du prononcé de la pénalité mentionnée à l’article R. 4163-33.
