Article R4163-7 of the French Labour Code

The secondment contract referred to in article L. 1251-43 indicates, with regard to the specific characteristics of the position to be filled and for the application of article L. 4163-1, to which occupational risk factors the temporary employee is exposed, in view of the usual working conditions assessed on average over the year by the user undertaking, characterising the position occupied.

If necessary, and at the initiative of the user company, an amendment to the secondment contract corrects the information mentioned in the first paragraph.

Le contrat de mise à disposition mentionné à l’article L. 1251-43 indique, au titre des caractéristiques particulières du poste à pourvoir et pour l’application de l’article L. 4163-1, à quels facteurs de risques professionnels le salarié temporaire est exposé, au vu des conditions habituelles de travail appréciées en moyenne sur l’année par l’entreprise utilisatrice, caractérisant le poste occupé.


En tant que de besoin et à l’initiative de l’entreprise utilisatrice, un avenant au contrat de mise à disposition rectifie les informations mentionnées au premier alinéa.
