Article R422-49 of the French Intellectual Property Code

A partner temporarily banned from practising his profession retains, for the duration of his sentence, his status as a partner with all the rights and obligations arising therefrom, with the exception of his entitlement to any remuneration paid by the company in connection with the performance of his professional activity.

In the event of suspension of the practice of the profession affecting all the members of the private practice company, the performance of professional acts and the management of the company are ensured by one or more industrial property attorneys appointed by the Compagnie nationale des conseils en propriété industrielle.

L’associé interdit de ses fonctions à titre temporaire conserve, pendant la durée de sa peine, sa qualité d’associé avec tous les droits et obligations qui en découlent, à l’exclusion de sa vocation aux rémunérations versées par la société en relation avec l’exercice de son activité professionnelle.

En cas de suspension d’exercice de la profession frappant l’ensemble des associés de la société d’exercice libéral, l’exécution des actes professionnels et la gestion de la société sont assurées par un ou plusieurs conseils en propriété industrielle désignés par la Compagnie nationale des conseils en propriété industrielle.
