Article R4234-11 of the French Public Health Code

The Disciplinary Chamber of first instance must give its decision within six months of the date of receipt by that Chamber of the complete file of the complaint or request.

On expiry of this period, any party may ask the President of the National Disciplinary Chamber to refer the case to another Disciplinary Chamber. Such a request shall not have the effect of removing the case from the Disciplinary Board of first instance to which the matter was initially referred.

Where justified by considerations relating to the proper administration of justice, the President of the National Disciplinary Board may assign the case to a Board designated by him.

The time limits provided for in this article shall be counted in accordance with the provisions of articles 640 to 644 of the Code of Civil Procedure.

La chambre de discipline de première instance doit statuer dans un délai de six mois à compter de la date de réception par cette chambre du dossier complet de la plainte ou de la requête.


A l’expiration de ce délai, toute partie peut demander au président de la chambre de discipline nationale de transmettre le dossier à une autre chambre de discipline. Cette demande n’a pas pour effet de dessaisir la chambre de discipline de première instance initialement saisie.


Lorsque des considérations de bonne administration de la justice le justifient, le président de la chambre de discipline nationale peut attribuer l’affaire à une chambre qu’il désigne.


Les délais prévus au présent article sont décomptés conformément aux dispositions des articles 640 à 644 du code de procédure civile.
