Article R4234-14 of the French Public Health Code

The parties shall be informed that they may be represented or assisted by a lawyer.

However, pharmacists, whether they are plaintiffs, claimants or the subject of the proceedings, may be assisted either by a lawyer or by a colleague entered on one of the Rolls of the Association, or by both. This colleague may not be a member of a Council of the Bar.

The President of the National Council or of a Central or Regional Council may be represented by a full or alternate member of his Council; trade unions and associations may be represented by their legal representative or by one of their members in possession of a mandate. The latter may not be a member of a Bar Council.

Parties who have chosen to be represented or assisted shall inform the court registry in writing.

When a party is represented by a lawyer, the procedural acts, with the exception of the summons to the hearing and the notification of the decision, are carried out only with regard to the lawyer.

Les parties sont averties qu’elles ont la faculté de se faire représenter ou assister par un avocat.

Toutefois, les pharmaciens, qu’ils soient plaignants, requérants ou objets de la poursuite, peuvent se faire assister soit par un avocat, soit par un confrère inscrit à l’un des tableaux de l’ordre, soit par l’un et l’autre. Ce confrère ne peut être membre d’un conseil de l’ordre.

Le président du Conseil national ou d’un conseil central ou régional peut se faire représenter par un membre titulaire ou suppléant de son conseil, les syndicats et les associations peuvent se faire représenter par leur représentant légal ou un de leurs membres muni d’un mandat. Celui-ci ne peut être membre d’un conseil de l’ordre.

Les parties qui ont fait le choix d’être représentées ou assistées en informent le greffe par écrit.

Lorsqu’une partie est représentée par un avocat, les actes de procédure, à l’exception de la convocation à l’audience et de la notification de la décision, ne sont accomplis qu’à l’égard de ce dernier.
