Article R4234-23 of the French Public Health Code

I.-A member of the court who considers that there are grounds for disqualification in his or her person or who conscientiously considers that he or she should abstain shall be replaced by another member appointed by the president of the court.

If a full member of the Disciplinary Board is unable to attend or abstains, or if he or she agrees to a request for disqualification, he or she may be replaced by one of the substitute members.

II – Articles R. 721-2 to R. 721-9 of the Code of Administrative Justice relating to abstentions and challenges are applicable before the Disciplinary Board of First Instance and the National Disciplinary Board.

I.-Le membre de la juridiction qui suppose en sa personne une cause de récusation ou estime en conscience devoir s’abstenir se fait remplacer par un autre membre que désigne le président de la juridiction.


En cas d’empêchement ou d’abstention d’un membre titulaire de la chambre de discipline ou si celui-ci acquiesce à une demande de récusation, il peut être remplacé indifféremment par un des membres suppléants.


II.-Les articles R. 721-2 à R. 721-9 du code de justice administrative relatifs à l’abstention et à la récusation sont applicables devant les chambres de discipline de première instance et devant la chambre de discipline nationale.
