Article R4234-26 of the French Public Health Code

The Chairman of the Disciplinary Board chairs the proceedings. He first gives the floor to the rapporteur to read his report. The chairman then gives the floor to the parties and, where appropriate, to the witnesses. The pharmacist being prosecuted must be given the opportunity to speak last. The court may also question all parties present at the hearing. When the provisions of article R. 623-1 of the Code of Administrative Justice are applied, the chairman of the Disciplinary Board shall proceed in accordance with these provisions.

Le président de la chambre de discipline dirige les débats. Il donne tout d’abord la parole au rapporteur pour la lecture de son rapport. Le président donne ensuite la parole aux parties ainsi que, le cas échéant, aux témoins. Le pharmacien poursuivi doit être mis à même de prendre la parole en dernier. La formation de jugement peut également interroger toutes les parties présentes à l’audience. Lorsqu’il est fait application des dispositions de l’article R. 623-1 du code de justice administrative, le président de la chambre de discipline procède selon ces dispositions.
