Article R4234-44 of the French Public Health Code

The decision of the national disciplinary chamber or the order of the president of that chamber made pursuant to article R. 4234-3 becomes final on the day on which the pharmacist receives notification thereof.

If the notification is returned to the registry with the words “envelope notified and not collected” or “envelope notified and not collected”, it becomes final on the date of presentation of the envelope at the pharmacist’s address.

If the notification is returned with the words “addressee unknown at address”, it becomes final on the date of the postmark.

If the notification is made directly by a bailiff, it becomes final on the date of service.

La décision de la chambre de discipline nationale ou l’ordonnance du président de cette chambre prise en application de l’article R. 4234-3 devient définitive le jour où le pharmacien en reçoit notification.

Si la notification est retournée avec la mention “ pli avisé et non réclamé ” ou “ pli avisé et non réclamé ” au greffe, elle devient définitive à la date de présentation du pli à l’adresse du pharmacien.

Si la notification est retournée avec la mention “ destinataire inconnu à l’adresse ”, elle devient définitive à la date du cachet de la poste.

Si la notification est faite directement par huissier de justice, elle devient définitive à dater de cette signification.
